Distance Sales Agreement

This Distance Sales Agreement is established in accordance with the Law on Consumer Protection No. 6502 and the Regulation on Distance Contracts of the Republic of Turkey.

Buyer / Customer:

The natural or legal person who reserves and purchases a tour or travel service through the platforms of Nova Cartago Travel Agency including website and social media.

The Buyer must ensure the accuracy and completeness of personal details during the booking process.

2. SUBJECT OF THE AGREEMENT

This Agreement regulates the sale and delivery of tourism and travel services (including but not limited to balloon flights, daily tours, private transfers, cultural activities, and guided excursions) provided by the Seller and purchased by the Buyer electronically.

All bookings, payments, and related transactions conducted via the Nova Cartago Travel Agency (referred to as Nova Cartago hereafter) website or mobile application are governed by this Agreement.

3. DESCRIPTION AND PRICE OF SERVICES

Details including type, scope, duration, total price, currency, and payment method of each service are presented on the relevant booking page for confirmation.

All prices are listed in TRY (Turkish Lira), EUR (Euro), or USD (US Dollar), and the currency chosen during checkout defines the final payment amount.

Nova Cartago retains the right to modify tour descriptions and prices prior to booking confirmation.

4. PAYMENT AND CONFIRMATION

Payment needs to be finalized at the moment of booking unless a written deferred payment arrangement has been authorized.

Accepted payment methods include major credit/debit cards (Visa, Mastercard) and bank transfers to the company's designated Turkish bank accounts.

Following successful payment, the Buyer shall receive an electronic Booking Confirmation and Tour Voucher via email within 24 hours.

The delivery of these documents constitutes the "service delivery" under this Agreement.

5. RIGHT OF WITHDRAWAL

As per Article 15(g) of the Distance Sales Regulation, the right of withdrawal does not apply to services related to accommodation, transportation, catering, or leisure activities that must be performed on a specific date or within a specific timeframe.

Nevertheless, Nova Cartago provides the following flexible cancellation policy favoring the Buyer:

Hot Air Balloon Tours: Full refund for cancellations made at least 24 hours prior to the scheduled start time.

Other Tours: Full refund for cancellations made at least 24 hours before the tour launching time.

No-Shows or Late Arrivals: Non-refundable.

Weather-Related Cancellations: Full refund or free rescheduling, as preferred by the Buyer.

Refunds for eligible cancellations will be processed within 5 to 10 business days back to the original payment method.

6. FAILURE TO DELIVER OR FORCE MAJEURE

Should the Seller be unable to deliver the booked service due to force majeure situations such as adverse weather, natural disasters, government restrictions, or safety-related aviation cancellations, the Buyer shall have the right to:

Reschedule the tour for a different available date,

Exchange it for another tour of equivalent value, or

Receive a full refund.

Nova Cartago is not accountable for losses or damages caused by events beyond its reasonable control.

7. BUYER'S RESPONSIBILITIES

The Buyer should review all service details, including pickup point and time, prior to the tour date.

The Buyer must adhere to all safety instructions and guidelines given by Nova Cartago's staff, pilots, or guides.

The Buyer is responsible for ensuring their own health and fitness suitability for activities such as hot air ballooning, ATV rides, or hiking.

Nova Cartago disclaims liability for loss or damage to personal belongings or injuries arising from the Buyer's negligence or failure to follow directions.

8. DATA PROTECTION AND PRIVACY

Touranos Tourism Travel Agency and Trade Limited Company processes all personal data in accordance with Turkish Personal Data Protection Law No. 6698 (KVKK) and GDPR (when applicable).

Personal data is collected solely for booking, communication, legal compliance, and operational needs.

9. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement is subject to the laws of the Republic of Turkey.

Any disputes arising from this Agreement shall be settled by the Consumer Arbitration Committees and Consumer Courts in Nevşehir, Turkey, in accordance with the monetary limits prescribed by law.

Both parties acknowledge and agree to the exclusive jurisdiction of these authorities.

10. EFFECTIVENESS AND ACCEPTANCE

By clicking the "Confirm Booking" or "Complete Reservation" button on the Nova Cartago website, the Buyer conveys that they have read, understood, and accepted this Distance Sales Agreement in its entirety.

This Agreement is executed electronically and is legally binding under Law No. 5070 on Electronic Signatures.
